Terms and Conditions
of KONTROLL s.r.o., ID No. 28138643, effective as of September 1, 2024
These terms and conditions regulate the relationship between the provider and the client in the provision of services as per the concluded contract for performing inspection activities.
1. Subject of the Contract
1.1. Under this contract, the provider agrees to impartially assess the condition of the inspected property with professional care for the purpose of asserting rights from defective performance (in case of ordering a technical inspection of the property) or for identifying visible defects in the inspected property (in case of ordering a factual property condition assessment) and to issue an inspection certificate (hereinafter also referred to as the “report”), and the client agrees to pay the agreed fee.
1.2. Assessment of the condition of the inspected property means comparing its structural and technical condition with applicable legal regulations, mandatory technical standards, general construction procedures, and documents provided by the client, within the scope agreed upon in this contract.
2. Price
2.1. The agreed price includes all the provider’s costs. The price will be paid based on a tax document issued on the date of service order online through the secure payment gateway STRIPE or by transfer based on an invoice. The client agrees to receive the tax document electronically.
2.2. Transportation costs are included in the service price.
3. Report
3.1. The report for the factual property condition assessment service includes a protocol on the actual condition of the inspected property, summarizing information on inspected components, an expert evaluation of its technical condition, a description of visible defects, and a rough estimate of the cost of remedying visible defects.
3.2. The report may include a list of recommendations and warnings for the use or reconstruction of the inspected property.
3.3. The provider will send the report, including any attachments, to the client within the agreed deadline for report delivery by email or will store it using a web repository and send the client an email link to this repository.
4. Method of Inspection
4.1. The inspection is conducted exclusively in a non-destructive manner and solely by the following methods (if applicable): visual inspection, laser distance measurement, electric voltage tester, right-angle gauge, inclinometer, and infrared thermometer.
5. Inspector
5.1. The inspector must have construction education and appropriate professional training. The inspector is not a public authority or similar body.
5.2. The inspector is not obliged to enter hazardous areas, such as sloped roofs, or areas where there is a risk of injury or damage.
6. Insurance
6.1. The provider commits to maintaining liability insurance covering damages caused by the provider’s activities throughout the performance of this contract, with a minimum insurance coverage of 500,000 CZK.
7. Scope of Inspection
7.1. The inspection includes an examination of load-bearing and non-load-bearing walls, floors, roofs, terraces, underground spaces, basements, openings, inspection of accessible technical equipment, distributions, and technical installations.
7.2. The inspection does not include examination of invisible or inaccessible parts of the property, nor specialized surveys, such as geological, geotechnical, or hydrological surveys.
8. Cooperation
8.1. The client agrees to cooperate with the provider to conduct the inspection, including providing access to the inspected property and necessary documents.
9. Disclaimer of Liability
9.1. The client acknowledges that this inspection cannot determine the complete structural and technical condition of the inspected property. The inspection does not include and cannot include asbestos, radon, methane detection, or a detailed analysis of wooden structures.
10. Personal Data Processing
10.1. The provider processes the client’s personal data for contract fulfillment. Personal data may be disclosed to the provider’s employees and other individuals involved in fulfilling the contract.
11. Use of Photographs for Commercial Purposes
11.1. The client agrees to the use of photographic documentation of the inspected property for the provider’s commercial presentations, provided that such documentation does not allow identification of the property, the client, or the property owner without their explicit consent.
12. Governing Law
12.1. This contract is governed by Czech law. The courts of the Czech Republic shall have jurisdiction over disputes arising from this contract.
